Abstract (2. Language):
The idea that the Islamic public law literature had not take a progress is a common opinion among the scientist. In this study, the uprightness of above-mentioned thesis and the probable reasons of the insufficiency of classical literature and assumptions are dealt with. As a result, the common idea is not in approriate for all the branches of public law but in administration and constitution law and general public law (state law). In this issue, besides the reasons arise from the revaluation, that the socio-political factors had effected is convicted.

İslam kamu hukuku literatürünün yeterince gelişmediği inancı ilim adamları arasında yaygın bir kanaattir. Çalışmamızda söz konusu tezin isabetlilik payı, kamu hukuk alandaki klasik literatürün gelişmemesinin muhtemel nedenleri ve varsayımlar ele alınmıştır. Netice itibariyle, mezkûr tezin bütün kamu hukuku dalları için geçerli olmadığı ancak idare, anayasa ve genel kamu hukuku alanlarında bir yetersizliğin söz konusu olduğu, bu konuda da vahiy kaynaklı bir takım sebeplerin yanı sıra, sosyo-politik faktörlerin etkin olduğu kanaatine varılmıştır.
