Abstract (2. Language):
In the arrangement of the Labour Act, a labour system which is not disturbing the public order was aimed and with respect of this aim, the concepts of "morals" and "good faith " were taken as the starting point while forming the rules. Since both of these concepts are "abstract", it is not easy to find out a clear and definite measure which can be applied to the concrete cases.
While it is stated in the Labour act that, in the event of the worker (art. 24/(1) or the employer (art.25/fi) became the subject of the behaviors and the acts which are the examples of the conditions contrary to the morals and good faith rules, the other party could terminate the labour contract with rightful reasons; not the aim and the intention but the appeared will of the doer was taken account. In this respect, "objective ethics", in other words "law" should be understood from the expression of "moral rules", stated within the title of Articles 24/11 and 25/11.
Concept of "morals" does not mean so different also from the view of Code of Obligations. The Lawmaker is giving a legal meaning to morals, protecting the main values recognized by the public in the collective life and aiming the parties of the collective life to stay away from transactions contrary to the morals by forbidding the concluding of the contracts whose subject or aim is contrary to the morals. "General morals" is the concept which is meant here, because while saying "contrary to morals", not subjective but objective ethics, in other words "social ethical standards of judgement" is being stated.

İş Kanununun düzenlenmesinde, toplumsal düzeni bozmayacak bir çalışma hayatı amaçlanırken, uyutması gereken kurallar açısından "ahlak" ve "iyiniyet" kavramları hareket noktası olarak kabul edilmiştir. Her iki kavram da "soyut" olduğundan, somut olaylara uygulayabileceğimiz açık ve net bir Ölçü bulmak kolay değildir.
iş Kanununun 24/11. maddesi ile işverenin, 25/11. maddesi ile de, işçinin, ahlak ve iyiniyet kurallarına uymayan haller ve benzerlerine örnek teşkil eden davranış ve fiillerin süjesi olması halinde diğer tarafça iş sözleşmesinin haklı sebeple feshedilebileceği düzenlenirken, faillerin niyeti ve kasdı değil, bizzat dışa dönük iradesi madde kapsamında incelenmiştir. Bu anlamda, md.24/IÎ ve 25/11'nin başlığında yer alan "ahlak kuralları" deyiminden "objektif etik" yani "hukuk" anlaşılmalıdır.
"Ahlak" kavramı Borçlar Kanunu bakımından da çok farklı bir anlam taşımamaktadır. Kanun koyucu, konusu ya da amacı ahlaka aykırı olan sözleşmeler yapılmasını yasaklayarak, ahlaka hukuki bir değer vermekle, insanların toplum halinde yaşamalarında toplumun tanıdığı temel değerleri korumakta, tarafların ahlaka aykırı işlemlerden uzak dunnalarını amaçlamaktadır. Burada genel ahlak kavramı kastedilmektedir, çünkü "ahlaka aykırılık" denirken sübjektif değil, objektif etik anlayışı yani "toplumsal ahlaki değer yargıları" ifade edilmektedir.
