Abstract (2. Language):
This study analyzes the relationship between sovereignty and law. The functions of
law and the relationship between political power and ideology are discussed. These
functions consist of the legitimization of the status quo, the creation of the person of the
state and the reconstruction of the society in terms of the social and political engineering .
In this study, law is examined and criticized as the means of the state, from the point
of view of Locke and liberal tradition, in the classical theory of which Machiavelli, Bodin,
Hobbes and Rousseau leaded.

Bu çalışma egemenlik ve hukuk ilişkisini incelemektedir. Çalışmada hukukun
fonksiyonları ve devlet ve ideoloji ile ilişkileri tartışılmaktadır. Bu fonksiyonlar; siyasal
iktidarın kurulu düzeninin meşrulaştırılması, devletin kişisinin yaratılması ve toplumun
sosyal ve siyasal mühendislikle yeniden kurulması olarak incelenmektedir.
Çalışmada, öncülüğünü Machiavelli, Bodin, Hobbes ve Rousseau’nun yaptığı
klasik/kurucu egemenlik teorisindeki hukukun devletin bir aracı olarak ele alınması
tartışılmakta ve bu yönüyle Locke ve liberal gelenek ışığında bu teoriler eleştirilmektedir.
