The idea of an International Criminal Court (ICC), which has a history of over one century, was finally shaped in the Rome Conference in 1998 and implemented with the establishment of the Court in 2002. Within this process, terrorism has become one of the most serious security risks of the post-Cold War era and has grad-ually had an international characteristic. In this context, there have been attempts to include terrorist offenses in the scope of jurisdic-tion of the Court in order to war on international terrorism; howev-er, they have remained inconclusive. This study will cover the his-torical development of ICC idea, the establishment process of ICC, and terrorist offences. Based on the idea that terrorist offences should be accepted as crimes against humanity, the study will final-ly analyze different types of terrorist offences according to the Article 7 of Rome Statute.

Özet Yüz yılı aşan bir geçmişe sahip Uluslararası Ceza Mahkemesi (UCM) düşüncesi nihayet 1998 yılında Roma Konferansı ile şekil-lendirilebilmiş ve 2002 yılında Mahkeme'nin kurulması ile birlikte 55 hayata geçirilmiştir. Bu süreçte terörizm, Soğuk Savaş sonrası dö- Güvenlik nemin en önemli güvenlik risklerinden birisi haline gelmiş ve gide- ^^g™ rek uluslararası bir niteliğe sahip olmuştur. Bu kapsamda uluslara- sayı: 15 rası terörizmle mücadele açısından, terör suçlarının da Mahke-me'nin yargı kapsamına alınmasına dair girişimler söz konusu ol¬muş, ancak bu girişimler sonuçsuz kalmıştır. Bu çalışmada öncelik¬le UCM düşüncesi'nin tarihsel gelişimine yer verilecek, ardından UCM'nin "kuruluş süreci" ve "terör suçları" ele alınacaktır. Son olarak terör suçlarının da insanlığa karşı bir suç olarak kabul edil¬mesi gerektiği düşüncesinden hareketle, muhtelif terör olaylarıyla Roma Statüsü'nün 7. maddesi karşılaştırmalı olarak değerlendirile¬cektir.
