Abstract (2. Language):
In Turkish Commercial Code, passenger transportation by sea has been arranged
only in fourteen articles. Despite the lack of the definition of the agreement relating
passenger transportation by sea; rights and liability of passengers, luggage, repair of
vessel during voyage, dismissal of agreement etc. are the topics to be covered under
certain substitles In these articles, the frequent references to the carriage of goods by
sea are sharply noticable. Actually carrier’s liability is the main issue to be
thoroughly discussed in details. In International Law, the subject is stated in Athens
Convention relating to the Carriage of Passengers and their Luggage by Sea (PAL)
1974, and it’s Protocols of 1976, 1990 and 2002. However Turkey has participated
none of the mentioned conventions.Yet, recently, because of the immence increase
in international relations, in the agreements of passenger transportation, these
articles are inevitably stated or referred. Furtermore in the draft Commercial Code,
certain articles are transferred or adopted.

Ticaret Kanunu’nda deniz yolu ile yolcu tasıma; yolcu tasıma mukavelesi baslıgı
altında 14 madde halinde düzenlenmistir. Bu maddeler incelendiginde; deniz yolu
ile yolcu tasıma sözlesmesinin tanımının yapılmamıs olmasına ragmen, sık sık esya
tasıma sözlesmesi hükümlerine atıf yapıldıgı dikkat çekmektedir. Oysa, deniz yolu
ile yolcu tasıma sözlesmelerinde özellikle tasıyanın sorumlulugunun etraflıca düzenlenmesi
gereklidir. Uluslararası mevzuatta; 1974 Denizde Yolcu ve Bagajların Tasınmasına
Dair Atina Konvansiyonu ve 1976, 1990 ve 2002 Protokolleri ile bu konu
düzenlenmistir. Türkiye bu Konvansiyon ve Protokollerin hiç birine henüz taraf degildir.
Ticaret Kanunu Tasarısı’nda, Konvansiyon’un bazı maddeleri aynen yer almaktadır.
Çalısmamızda, yolcu tasıma sözlesmesine iliskin eksikliklerin incelenmesi
ve öneriler getirilmesine çalısılmıstır.
