The Possibility of Third States' Intervening the Pirates within Territorial Seas: The Somalia Case

Abstract (2. Language): 
Since 1990's Somalia has lost her authority and declared her incapacity to combat piracy which has been starting at high seas and ending in the Somalia's territorial sea over the years. While international law is clear and specific regarding piracy, it has no saying towards the possibility that if pirates enters into territorial seas. Thus international society seeks an answer to this question. The aim of this article is to seek an answer to the following question: Under which circumstances may international law allow third state(s) at the expense of breaching sovereign rights of another state in order combating piracy? What kind of jurisdictional rules are available in international law for the pirates who are captured at territorial seas?

1990'lı yılları takiben otoritesini kaybeden Somali, yıllarca devam ede gelen açık denizlerde başlayıp kendi karasularında son bulan deniz haydutluğuyla mücadele edememiş ve uluslararası topluma bu acziyetini deklere etmiştir. Uluslararası hukukun deniz haydutluğuna ilişkin kuralları net iken, haydutların karasularına in¬tikal etmeleri ihtimaline yönelik bir kuralı yoktur. Bu nedenle uluslararası toplum bu meseleye cevap aramaktadır.
