Abstract (2. Language):
History of law begins, develops and lasts along with the history of civilisation. It is obligatory for a jurist
to know, not only how the legal notions and institutions developed and changed, but also its social,
economic and political background. A jurist shall now the history of his and other civilisations’ positive
law besides the positive law itself. Thanks to this knowledge, jurist may comprehend which his law
belong and its reasons. Knowledge of history shall also improve the jurist’s ability to compare and
evaluate the legal systems by reflecting the reasons and conditions of their creation. Because of the
mentioned reasons, this article emphasises the importance of general history of law by comparing history
with history of law and general history of law withnational history of law

Hukukun Tarihi, medeniyetle başlar, birlikte gelişir ve birlikte sona ererler. Hukuki kavram ve
kurumların nasıl geliştiğini, hangi sosyal, ekonomik ve siyasi ihtiyaçlarla değiştiğini bilmek bir hukukçu
için zorunludur. Hukukçu sadece kendi pozitif hukukunu değil, pozitif hukukunun tarihini veya diğer
medeniyetlerin hukuk tarihini de bilmelidir. Bu bilgi hukukçunun kendi hukukunun, hangi hukuk sistemi
içinde yer aldığını, neden yer aldığını, diğer hukuk sistemlerine oranla seçilme sebep ve koşullarını,
üstün taraflarını değerlendirebilme meziyetini de geliştirecektir. Bu nedenlerden dolayı, makalede tarih-hukuk tarihi, umumi hukuk tarihi-milli hukuk tarihiayrımı üzerinde durularak umumi hukuk tarihinin
önemi vurgulanmıştır.
