Abstract (2. Language):
While freedom of thought is recognized as an absolute, freedom of expression is limited in the
constitution. The advancement of technology led to a reduction of cultural differences
sometimes lead to these differences come to the fore. Some crimes listed in the Turkish Penal
Code can be processed due to differences like racial, religious, ethnic, political and sexual.
Also one of the this kind of crimes listed in the Turkish Penal Code is crime of incitement to
hatred and hostility. This crime is in the 216. article of the Turkish Penal Code. This crime
can be processed due to differences like social class, race, religion, sect or region and for the
crime also a clear and imminent danger to public safety must occur.

Anayasamızda düsünce özgürlügü mutlak olarak tanınmıs iken; düsünceyi açıklama
özgürlügü sınırlanmıstır. Teknolojinin ilerlemesi, kültür farklılıklarının azalmasına yol
açarken; bazen de bu farklılıkların ön plana çıkmasına neden olmaktadır. Türk Ceza
Kanununda sayılan bazı suçlar ırksal, dinsel, etnik, siyasal, cinsel vs. farklılıklar sebebiyle
islenebilir. Türk Ceza Kanununda sayılan bu tür suçlardan bir tanesi de halkı kin ve
düsmanlıga tahrik suçudur. Bu suç, Türk Ceza Kanununun 216. maddesinde düzenlenmistir.
Bu suç, sosyal sınıf, ırk, din, mezhep veya bölge farklılıkları sebebiyle islenebilmektedir ve
suçun olusması için ayrıca kamu güvenligi açısından açık ve yakın bir tehlikenin ortaya
çıkması gerekmektedir.
