Abstract (2. Language):
Article 31 of the Law of Administrative Procedure provides that in cases where there is no
applicable provision in the text, relevant provisions of the Code of Civil Procedure shall ap-ply. The subject matter of this study i.e. “notice of the litigation to third party” is one of those
instances where the Law of Administrative Procedure includes no specific clause; therefore it
is the Code of Civil Procedure that applies.
It should be noted, however, that legal opinions of the authors of Administrative Procedure
Law on the subject do not appear to be in agreement. The main reason for the diversity of
opinions stems from the fact the “notice to third party” is a typical “civil” procedural con-cept and to some extent alien to the “administrative” procedure.
The author is of the opinion that in certain cases of administrative litigation the principle of
“fair trial” necessitates the implementation of the “notice to third party”. However, when
implemented in the field of Administrative procedure, certain p eculiarities of this field should
duly be taken into account.

Bu çalışmada İdari Yargılama Usulü Kanunu'nun 31. maddesinde Hukuk Usulü Muhakemele-ri Kanunu'na atıf yapılan hallerden “davanın ihbarı”, medeni yargılama hukuku ve idari
yargılama hukuku bakımından ortak ve ayrışan yönleriyle incelenmektedir.
Davanın ihbarı tipik bir medeni yargılama hukuku kurumu olup idari yargılama hukuku
öğretisinde bu kurumun idari yargıdaki konumu tartışmalıdır. Davanın ihbarının idari
yargının kendine özgü özellikleri dikkate alınarak idari yargı yerlerinde uygulanması dürüst
(adil) yargılamanın sağlanması için gereklidir.
