Abstract (2. Language):
Constitutions have unamendable or perpetual provisions in order to strengthen its function on
defining the nature and extent of government and providing stability for the society.
Eternity (entrenchment) clause in the Constitution has an implicit understanding indicates
that the clause is unamendable. There is an unwritten difference and hierarchy between
constituent power and the legislative branch which amends the constitution.
On the other hand it is important not to confuse the stability of the Constitution with
constitutional stagnation. A constitution should meetthe needs of today and the future. It is
possible to solve these problems by the reviews of Constitutional Courts without any need for
complicated political reforms made by the Parliments.

Diğer yandan Anayasanın istikrarıdurağanlıkla karıştırılmamalıdır. Anayasa sadece bugü-nün değil geleceğin de gereksinmelerini karşılayabilmelidir. Parlamentoların tereddütle kar-şılanacak karmaşık siyasal reform girişimlerine gerek kalmadan Anayasa Mahkemelerinin
yapacaklarıyorumlarla bu tür sorunlara çözüm getirilmeleri mümkündür.
