Although banned by law and punished heavily, Turkish police are sometimes accused of maltreatment of suspects in custody or even torturing them. These kinds of allegations and counter al-legations occupy public agenda from time to time. Yet, due to lack of independent monitoring in police custody units, it is usually hard to determine whether these allegations are genuine or just a black-propaganda. In line with the arguments, the article evaluates “Independent Custody Visiting” system implemented in the UK and makes some recommendations for Turkey to implement, which would benefit all sides and interested parts of criminal in-vestigations; the suspects, the police, and the public.

Türkiye’de polis tarafından gözaltında alınan kişilere kötü mua-mele veya işkence yapıldığı iddiaları zaman zaman kamuoyu-nun gündemini meşgul edebilmektedir. Bir insanlık suçu olan iş-kence veya kötü muameleye bütün medeni ülkeler gibi ülkemizde de sıfır tolerans gösterilmekte ve önlenmesi için gerekli tedbirler almaktadır. Ancak, alınan birçok tedbirlere rağmen, ülkemizde ba-ğımsız bir gözaltı gözlemciliği sisteminin bulunmamasından kay-naklanan birçok sıkıntılar, hak ihlalleri veya imaj sorunları yaşa-nabilmektedir. Bu yazıda nezaret altına alınan suç şüphelilerinin haklarının korunması konusunda İngiltere’de uygulanan “Bağımsız Gözaltı Gözlemciliği” sistemi incelenerek ülkemizde de benzeri bir uygulamanın gözaltındaki zanlılarının haklarının korunması, polis ve toplumsal ilişkiler üzerindeki etkileri değerlendirmektedir.
