The auditing of the administrations with general budget and supplementary (annexed) budget is laid down as the task of Turkish Court of Account by the article 160 of Constitution of Republic of Turkey dated 1982. Nevertheless, the auditing of local administrations by Turkish Court of Account is not stated as a Constitutional obligation. However, the above mentioned article enables new auditing tasks to be added for Turkish Court of Account by other laws. Depending on the basis of this article, by the supplementary Article 8 of Law of Court of Account No:832, referring to the Law of Court of Account dated 1934, No:2514, the continuity of auditing of local administrations by Turkish Court of Account is ensured. In the reffered Law No:2514 and Financial Accounting Law dated 1927, No:1050, it is stated that accounts of local administrations are under “secondary” supervision of Turkish Court of Account. By the “secondary” auditing, the prior auditing of local administrations by their elected and authorized administrative agencies is meant.
There is not any provision that the auditing of Turkish Court of Account shall be a “secondary” auditing in the recently enacted Laws such as Municipality Law, Law of Provinces, Public Fiscal Management and Control Law, Public Administration Basic Law which is introduced as a reform. In this way, the dissimilarities between the auditing of local administrations and units of ministry is eliminated. To conclude, the approach of the Laws introduced as “Reform Laws”, is far from being democratic and these legislations enacted in 2000‟s lag behind the laws of 1920‟s.

Anayasanın 160.maddesinde, Sayıştayın görevi, genel ve katma bütçeli idarelerin denetimi olarak belirlenmiş olup, yerel yönetimlerin Sayıştayca denetimi Anayasal bir zorunluluk değildir. Ancak, anılan maddede, Sayıştayın bu görevine, kanunlarla başkaca denetim görevlerinin de eklenmesine olanak tanınmıştır. Bu olanaktan yararlanılarak 832 sayılı Sayıştay Kanununun geçici 8.maddesiyle 1934 tarihli, 2514 sayılı Sayıştay Kanununa atıfta bulunulmak suretiyle yerel yönetimlerin Sayıştayca denetiminin devamı sağlanmıştır. Atıf yapılan 2514 sayılı Kanun ile 1927 tarihli 1050 sayılı Genel Muhasebe Kanununda, yerel yönetim hesaplarının “ikinci derecede” Sayıştayın denetimine tâbi olduğu belirtilmiştir. İkinci derecede denetimden kasıt, yerel yönetimlerin, öncelikle yetkili, seçilmiş organlarınca denetlenmesidir.
Reform adı altında yakın zamanlarda çıkarılan Belediye Kanunu, İl Özel İdaresi Kanunu, Kamu Mali Yönetimi ve Kontrol Kanunu, Kamu Yönetimi Temel Kanunu gibi yasalarda ise, Sayıştay denetiminin “ikinci derecede” olacağına dair herhangi bir hüküm yer almış değildir. Böylelikle, Sayıştayın yerel yönetimler üzerindeki denetimiyle klâsik bakanlık birimlerinin denetimi arasında fark kalmamıştır. “Reform kanunları” olarak adlandırılan kanunların bu yaklaşımı demokratik olmaktan uzak olup, 2000‟lerde çıkarılan bu kanunlar, 1920‟lerde çıkarılan kanunların da gerisine düşmüştür.
