THE PLACE OF THE GUARDIAN (WALÍ) IN MARRIAGE CONRACTS ACCORDING TO ISLAMIC SECTS

Abstract (2. Language):
According lo Quran, the marriage must be controlled by the point of view of appropriateness for Maruf (The thing that its beauty can be understood by the way of religion and mind}. The Prophet Muhammed, explained that the guardian (Vaiy) would control the appropriateness for Maruf. If there occurs a disagreement in marriage contracts, the authority must be given to Civil Authority. Among the Islamic sects (Mazhaps), there is not an approach that accepts Quranic verses as bases of Marriage and also accepts the Hadiths as the explanation of these verses. The result of this the necessary sensitiveness is not shown on appropriateness for Maruf.
The approaches have caused some difficulties at the marriage system. However if the appropriateness for Maruf in Quranic Verses is evaluated with traditions, tiıe maitiage would be established firmly on healthy principles.

Kur'an'a göre nikâhın, marufa uygunluk açısından denetlenmesi gerekir. Maruf; güzeüiği akıl veya din yoluyla anlaşılan şeydir. Hz. Peygamber, marufa uygunluğu velinin denetleyeceğini, anlaşmazlık olursa yetkinin kamu otoritesine geçeceğini açıklamıştır. Mezlıcplcr arasında, ayetleri esas alan, hadisleri onların açıklaması sayıp ona göre yorum yapan bir yaklaşım gözükmemektedir. Bu da evliliğin marufa uygunluğu hususunda gerekli hassasiyetin gösterilmemesi ne yol açmıştır.
Bu yaklaşımlar, evlilik kurumu ile ilgiîi sıkıntılara yol açmıştır. Halbuki, ayetlerdeki marufa uygunluk, hadislerle birlikle değerlendin Iscydi evlilik işlemleri sağlam esaslara bağlanabilirdi
