Abstract (2. Language):
The delay or not fulfilling the debt issue creates the default of the debtor. If the debtor has a fault on
coming to a default situation, he is obliged to make an additional payment for the loss of the creditor as
well as the default interest. The purpose of this is to form the property assets of the creditor before the
default date. In order to claim this loss, the creditor has to prove that he has loss because of this issue and
the debtor is responsible for this loss. In our country, inflation data, government security interests, deposit
interests and foreign exchange rates are taken intoaccount for calculating cumulative loss

Borçlanılan konunun ifası mümkün iken geciktirilmesi veya yerine getirilmemesi borçlunun temerrüdünü
oluşturur. Borçlu temerrüde düşmede kusurlu ise, temerrüt faizinin yanı sıra alacaklının oluşan zararının
giderilmesi için gerekirse ek ödeme yapmak yükümlülüğündedir. Bunun amacı, alacaklının temerrüt
tarihinden evvelki mal varlığı değerlerinin yeniden oluşturulmasıdır. Alacaklı bu zararı talep edebilmek
için zararı olduğunu ve bu durumdan borçlunun sorumlu olduğunu kanıtlamak zorundadır. Ülkemizde
munzam zararın hesaplanmasında, enflasyon verileri,devlet iç borçlanma senetleri faizleri, mevduat
faizleri ve döviz kurları dikkate alınmaktadır.
