The European Union has almost completed the process of economic integration, now it widens and deepens the process of political integration. One of the most important and dynamic areas of the political integration is the Justice and Home Affairs issue which was reverted in the Amsterdam Treaty to the Freedom, Security and Justice area. Amsterdam Treaty has made majör changes to this field which was part of the European Union law in the Maastricht Treaty. Nice Treaty could not implement the majör objectives vvhich were specifıed in the Tampere European Council, 1999. These majör objectives have finally been included into the Treaty Establishing a Constitution for Europe (European Constitution).

Ekonomik entegrasyonunu büyük ölçüde tamamlayan Avrupa Birliği, siyasal entegrasyon alanlarında işbirliğini giderek genişletmekte ve derinleştirmektedir. Bu alanlardan birisi ve en dinamik olanı ise Amsterdam Antlaşması ile adı Özgürlük, Güvenlik ve Adalet alanı olarak değiştirilen İçişleri ve Adalet alanıdır. Maastricht Antlaşması ile ilk kez Birlik hukuku içine dahil olan bu alanda, Amsterdam Antlaşması ile önemli değişiklikler yapılmıştır. 1999 yılında yapılan Tampere Avrupa Konseyi'nde belirlenen önemli hedefleri gerçekleştirmek, Nice Antlaşması ile mümkün olmayınca, bu hedefleri temel kurucu antlaşmaların içine almak ancak Avrupa için bir Anayasa Oluşturan Antlaşma (Anayasa) ile mümkün olmuştur. Fakat Anayasa ile yapılan düzenlemeler bu alanda hala ulusal egemenlik kaygılarından kaynaklanan endişelerin varlığının devamının bir kanıtı olmuştur. Bunun sonucu olarak Özgürlük, Güvenlik ve Adalet alanında topluluk metodu tümüyle uygulanamamış özellikle cezai alanlarda ve adli işbirliği konusunda, hükümetlerarası yöntem bu alandaki topluluklaştırma hedeflerinin gerçekleştirilmesine engel olmuştur.
