Sosyal Sigortayı umumi sigortalardan ayıran esas nokta, Sosyal Sigortanın kanuni mecburiyete istinad etmesidir. Sosyal Sigortanın uygulandığı, uygulanması gerektiği iş kollarında çalışanlar Sosyal Sigorta Sandıklarına dahil olmak mecburiyetindedirler.
