Abstract (2. Language):
Group contracts, collective bargaining law in our country, as a new application represents one of the most current issues. Which the model is based on the application of these new types itibarile inspired or not based on a model relying unclear. However, a system similar to the contractual provisions of the group «participation» (Beteüigung) adiyle Switzerland is recognized as a mechanism of the past.
Such model of Switzerland, one of the main trade union or trade unions on the one hand, on the other hand is a major employer in a big and important company or an employer sendikasile invited the main employer associations between employer firms, and this is done at company level collective bargaining agreement is a anatoplu other employers, trade unions and other subordinate «party» sıfatile is left open for participation. Grup Sözleşmeleri, ülkemizde toplu sözleşme hukukunda yeni bir uygulama olarak en güncel konulardan birini teşkil etmektedir. Bu yeni tür uygulamanın hangi modelden esinlendiği veya esas itibarile bir modele dayanıp dayanmadığı açıklık kazanmamıştır. Ancak grup sözleşmelerine benzeyen bir sistem «katılma» (Beteüigung) adiyle İsviçre'de geçmişe ait bir mekanizma olarak tanınmaktadır.
Söz konusu İsviçre modelinde, bir tarafta işçi sendikaları veya bir ana işçi sendikası, diğer tarafta büyük ve önemli bir işveren firması veya bir ana işveren sendikasile bu ana işveren sendikasının davet ettiği işveren firmaları arasında, işyeri düzeyinde bir anatoplu iş sözleşmesi yapılmakta ve bu toplu sözleşme diğer işverenlerin ve diğer tâli sendikaların «taraf» sıfatile katılmalarına da açık bırakılmaktadır. Böylece ülkemizde dayanışma aidatı ödeyerek toplu sözleşme hükümlerinden yararlanma mekanizmasını ifade etmek üzere kullanılan «katılma» sözcüğünün almanca karşılığı olan «Beteüigung» sözcüğü de, aslında bu tip sözleşmeler için kullanılmakta, diğeri için «katılma» değil, «eklenme» «yan yana gelme» anlamında «Anschluss» sözcüğü kullanımaktadır.
